Mexican Constitution
Article 27 of the Mexican Constitution prevents foreigners from owning real state on the “restricted zone” (55 kilometers from the ocean inland and 100 kilometers from both borders inland). So how is it that we see so many foreigners buying real state in Puerto Vallarta and Banderas Bay? They do it thru a Trust. In order to protect the Foreign investing the Mexican government created the Restricted Zone Trust. Only banks are allowed to provide this service. In simple terms the restricted zone trust functions as follows: The seller (the trustor) of the property contributes the property in to the trust, action for he/she gets a payment, the bank or fiduciary receives the property physically but the rights to use it and enjoy it are for the buyer (the trustee) who is a foreigner. This legal contract allows foreigners to designate substitute beneficiaries whom will be able to claim their rights upon proving the passing of the main trustee.
Restricted Zone Trust
In order for a foreigner to be able to set up a restricted zone trust, the chosen bank will have to request for an authorization to the Federal Government, which is known as a FOREING MINISTRY OF AFFAIRS PERMIT. While the bank gets this permit the chosen notary will have to work on the issuing of the deed that will contain the trust, getting the appraisal, the no lean certificate and all the necessary documents in order to have all the paperwork in order for the signing of the deed. This whole process can take up to 2 months approximately.
When buying a property you will get an estimate cost from the notary with the list of expenses needed for the issuing of the Trust Deed. Most of the times this list includes the Foreign Ministry of Affairs Permit fee (payable one time only and it is emitted to be valid for 50 years) as well as the trust fees: ACCEPTANTE (payable one time only) and 1st ANNUAL FEE. It is important that you know that your trust will generate an annual fee for as long as the trust is valid. The only way to be able to cancel a restricted zone trust is when the foreigner transfers to a Mexican citizen or becomes a Mexican citizen him/her self. So when buying a property here in the “restricted zone” you must have all this information in order for you to know what to expect. The most important decision after the choosing of the property is deciding the Fiduciary you will deal with for the next 50 years or as long as you keep your trust.
